HIPAA may be “long in the tooth,” but it still packs a powerful bite. To date, the Office for Civil Rights (OCR) has settled or imposed a civil monetary penalty in 95 cases totaling over $135 million. Recent settlements involve business associate agreements and release of, and delayed access to, patient records, much due to a lack of basic controls. Recent appellate court activity may indicate a need for future regulatory reform or increased pushback from organizations for a more commonsense approach.
