The pathology of COVID-19, coupled with the fact that the virus is most easily spread in indoor settings where individuals congregate, makes Long Term Care Facilities (LTCFs) highly vulnerable to outbreaks, with devastating results. . . . Yet other risks and challenges for LTCFs are increasingly coming into focus: a wave of investigations, litigation, and rapid regulatory changes have begun, and will continue for the foreseeable future. Properly addressing these legal issues will be essential for many LTCFs to remain solvent.
